የእሽሙር ማህበር ህጋዊ ሰውነት የሌለው እንዲሁም በጽሁፍ መረጋገጥና ሌሎች የንግድ ማህበሮችን በተመለከተ የተደነገጉት የማስታወቅና የማስመዝገብ ሥርዓቶች የማይፈፀምበት ነው በሚል ምክንያት ብቻ የእሽሙር ማህበርን አስመልክቶ ማህበሩ እንዲፈረስ በሚልና ሌሎች ተያያዥ ጉዳዬችን አስመልክቶ የሚቀርቡ አቤቱታዎችን ውድቅ በማድረግ የሚሰጥ ውሣኔ ተገቢነት የሌለው ስለመሆኑ፣  የእሽሙር ማህበር የንግድ ሥራ እንቅስቃሴ የሚያደርገው በሸሪኮቹ ስም ስለመሆኑና ሸሪኮቹም እንደተራ ተዋዋይ ወገኖች የሚታዩ ስለመሆናቸው የንግድ ህግ ቁ. 212(1),272
