ፍርድ ቤቶች ከሣሽ በክሱ ገልፆ በትክክል ዳኝነት የጠየቀበት ጉዳይ በቤት ላይ ያለውን የባለሀብትነት መብት ለማስከበርና የመፋለም ክስ ሆኖ እያለ ክሱ የቀረበው በአዋጅ የተወረሰ ቤት ወይም ከአዋጅ ውጪ በባለስልጣን ቃል ትእዛዝ ወይም በቀላጤ የተወሰደን ቤት ለማስመለለስ ነው በሚል ጉዳዩን የማየት ስልጣን የለኝም በማለት የሚሰጡት ውሣኔ ተገቢነት የሌለው ስለመሆኑ አዋጅ ቁጥር 47/67 የፍ/ብ/ህ/ቁ. 2257
