አንድ ተከሳሽ የተከሰሰበትን የወንጀል ክስ ይዘት በሚገባ ተረድቶና አድራጐቱን በተመለከተም እንደቀረበበት የወንጀል ክስ በዝርዝር መፈፀሙን ገልፆ በማመን የእምነት ቃሉን ሰጥቷል በሚል መነሻ በተከሣሹ ላይ የጥፋተኝነት ውሣኔ በአግባቡ ተሰጥቷል ለማለት ስለሚቻልበት አግባብ፣ ፍ/ቤቶች ተከሣሹ የቀረበበትን ክስ በተመለከተ በድርጊቱ አፈፃፀም ረገድ የገለፀውን ዝርዝር የአፈፃፀም ሁኔታ በመዝገብ ላይ ባለማስፈር በደፈናው ክሱን አምኗል በማለት የሚሰጡት የጥፋተኛነት ውሣኔ ተገቢ ስላለመሆኑ፣ የወ/መ/ሥ/ሥ/ቁ.134(1) የወ/ህ/አ.23
