ከውርስ ሀብት ክፍፍል ጋር በተገናኘ አንድ ሰው ሟች በተውት ኑዛዜ መሠረት የጥሬ ገንዘብ ክፍያ እንዲከፈለው ክስ አቅርቦ ገንዘቡ እንዲከፈል ዳኝነት ከተሰጠ በኋላ በሌላ ግዜ የሟቹ የውርስ ሀብት ይጣራልኝ በማለት የሚያቀርበው የዳኝነት ጥያቄ ተቀባይነት የሌለው ስለመሆኑ፣ ኑዛዜን መሠረት አድርጐ የሚቀርብ የኑዛዜ ተጠቃሚት መብት ይረጋገጥልን ጥያቄና የውርስ ይጣራልኝ ጥያቄዎች ተመሳሳይ የሆነ የፍሬ ነገርና የህግ ጥያቄ የሚያስነሱ ጉዳዬች ስለመሆናቸው፣ የፍ/ብ/ሥ/ሥ/ህ/ቁ. 5(2)
