ከወጪና ኪሣራ አወሣሠን ጋር በተገናኘ ከቅን ልቦና ውጪ ለክርክር የተዳረገ ወገን የክርከሩ ረቺ መሆኑ እስከታወቀ ድረስ ቅን ልቦና ከሌላው ወገን በክርክሩ ምክንያት ያወጣውን ወጪ እንዲተካለት በሚል ውሣኔ ሊሰጥ የሚገባ ስለመሆኑ፣ የወጪና ኪሣራ ጥያቄን አስመልክቶ ፍ/ቤቶች በመጠኑ ላይ ለመወሰን በህግ ስልጣን የተሰጣቸው ስለመሆኑና ረቺ የሆነ ወገን ሁል ግዜ ወጪና ኪሣራ እንዲተካለት ሊወሰን ይገባል ለማለት የማይቻል ስለመሆኑ፣ የፍ/ብ/ሥ/ሥ/ህ/ቁ. 462-464
