ባለፎቶግራፍ ወይም ባለስዕሉ ካልፈቀደ በቀር የማንም ሰው ፎቶግራፍ ወይም ስዕል በህዝብ አደባባይ ሊለጠፍም ሆነ ሊባዛ ወይም ሊሸጥ የማይችል ስለመሆኑና ፎቶው ወይም ስዕሉ ጥቅም ላይ ለዋለበት የማስታወቂያ ሥራ ባለፎቶው ወይም ባለስዕሉ ካሣ ሊከፈለው የሚገባ ስለመሆኑ፣ ለባለ ፎቶው ወይም ለባለስዕሉ የሚከፈለውን የካሣ መጠን ድርጊቱን የፈፀመው ሰው በዚሁ ድርጊት ያገኘው ሀብት (ጥቅም) ተመዛዛኝ በሚሆንበት መጠን በዳኛች ሊወሰን ስለመቻሉ፣ የፍ/ብ/ህ/ቁ 28 29(2), 2142
