አንድ ሠው በአንድ ወንጀል ድርጊት ክስ ቀርቦበት የመጨረሻ የሆነ ውሣኔ ተሰጥቷል በማለት በድጋሚ ልከሰስ አይገባም በሚል የሚያቀርበው ክርክር ከዚህ ቀደም ተጣርቶ ክስ የቀረበበትና የመጨረሻ ውሣኔ የተሰጠበት የወንጀል ድርጊትን በድጋሚ (ለሁለተኛ ጊዜ) ክስ ቀርቦበታል ከተባለው የወንጀል ድርጊት ጋር ተመሳሳይ መሆን አለመሆኑ ተገናዝቦ ሊታይ የሚገባው ስለመሆኑ፣ የወንጀል ህግ አንቀጽ 2(5), 678, 696(ሐ) እና 378 ህገ መንግስት አንቀጽ 23
