አንድ የመንግስት ሠራተኛ መ/ቤቱን በመወከል ተቋሙ ከ3ኛ ወገን ጋር ካለው አለመግባባት ጋር በተገናኘ በግልግል ዳኝነት ጉባኤ አባልነት በዳኝነት ተሰይሞ ለጉባኤው የሚከፈለውን አበል ክፍያ መወሰኑ የዲሲፕሊን ጥፋት ፈጽሟል ሊያስብለው የሚችል ስላለመሆኑ፣ በግልግል ዳኝነት ጉባኤ ዳኝነት የተሰየመ ዳኛ በህግ ስላለበት ኃላፊነት፣ የግልግል ዳኛ ሆኖ የተሰየመ ሰው በግልግል ዳኝነቱ የተጣለበትን ኃላፊነት በአግባቡ ካልተወጣ በወንጀል ተጠያቂነት የሚኖርበት ስለመሆኑ፣ የፍ/ብ/ሥ/ሥ/ህ/ቁ. 351(2)(መ), 317, 318(መ) የወንጀል ህግ አንቀጽ 399 የአ.አ ከተማ አስተዳደር ምክር ቤት አዋጅ ቁ. 6/2000 አንቀጽ 31
