አንድ በወንጀል ድርጊት ቅጣት የተጣለበትን ተከሳሽ ቅጣቱ እንዳይፈፀም ፍርድ ቤቱ ለማድረግ የሚችለው ጥፋተኛው በመልካም ጠባይ እንደሚመራ ፣ እንዲፈፅም የተሰጠውን ግዴታ እንደሚቀበል ፣ በሚቻለው መንገድ ሁሉ በጥፋቱ የደረሰውን ጉዳት እንደሚክስ ወይም ለተበዳዩ እንደሚከፍል እና ለዚሁ ጉዳይ በተወሰነ ጊዜ ውስጥ የፍርድ ቤቱን ወጪ እንደሚከፍል ማረጋገጫ ከሰጠ ስለመሆኑ፣ ከዚህም በተጨማሪ ፍርድ ቤቱ ጥፋተኛው ለገባበት ግዴታ አፈጻፀም መተማመኛ ዋስትና የሚጠይቅ ስለመሆኑ፣ አንቀጽ 197/1/ እና/2/
