የአንድ ሰው መብትና ግዴታ ለተወላጆቹ በውርስ ሊተላለፍ የሚችለው በሟቹ ምክንያት የሚቋረጡ ካልሆነ በቀር ሟቹ በሞተበት ቀን የነበሩት መብቶችና ግዴታዎች ስለመሆናቸው፣ የፍ/ሕ/ቁ. 826/2/ ሟች የድርሻ መልቀቅ ውል ፈጽሞ ከዚያም ኑዛዜ ቢያደርግና ይኽው ኑዛዜ የድርሻ መልቀቁን ውል እስካልነካ ድረስ የውሉን ተፈጻሚነት ሊያስቀር የማይችል ወይም በአዲሱ ኑዛዜ ተተክቷል ሊባል የማይችል ስለመሆኑ፣ የፍ/ሕ/ቁ. 900 እና 901
