አንድ ተከሳሽ የቀረበበት ክስ በይርጋ የሚቋረጥ መሆኑን ከጠቀሰ ከሳሹ ክሱ በሕጉ የተመለከተው ጊዜ ገደብ (ይርጋ) ያላለፈው መሆኑን፣ ጊዜው አልፎ ከሆነም ይርጋውን ሊያቋርጥ የሚችል ሕጋዊ ምክንያት መኖር ያለመኖሩን በተገቢው ማስረጃ ለማስረዳት የሚችልበት እድል ሳይሰጠው የተከሳሽ መቃወሚያ ብቻ መሰረት ተደርጎ ክሱ በይርጋ ቀሪ ነው ተብሎ ብይን የሚሰጥበት አግባብ ስነ ስርዓታዊ ስላለመሆኑ
