አንድን ክስ በመጀመሪያ መቃወሚያ ዉድቅ በማድረግ የተሰጠን ዉሳኔ ይግባኝ ሰሚ ፍ/ቤት ከሻረው በኋላ የስር ፍርድ ቤት በፍሬ ጉዳዩ ላይ ተገቢዉን እንዲወስን መመለስ ሲገባው ያን ሳያደርግ ፍሬ ጉዳዩን በተመለከተ ይግባኝ ሰሚው ፍ/ቤት ራሱ የሚሰጠዉ ዉሳኔ ማስረጃን መዝኖ ፍሬ ነገርን ከማረጋገጥ ጋር በተያያዘ ሊፈጠር የሚችለዉን ስህተት ለማሳረም ይግባኝ የማቅረብ መብትን ከማስፋት አንፃር ታይቶ ተፈፃሚነት ሊኖረዉ የሚገባውን የፍ/ብ/ሥ/ሥ/ሕ/ቁ አንቀፅ 341 ድንጋጌን ትክክለኛ አፈፃፀም ያልተከተለ ስለመሆኑ
