በጽሁፍ የተደረገ ውል በይዘቱ ውሉ ለጥቅሙ የተደረገለትን ሶስተኛ ወገን የማይገልጽ ከሆነ በውሉ ላይ በግልጽ ከተመለከቱት ከተዋዋዮች ሀሳብ ውጪ በመውጣት ተዋዋዩ ውሉን በስሙ የተዋዋለው ለራሱ ጥቅም ሳይሆን ለሌላ ሶስተኛ ወገን ጥቅም ነው በማለት በውሉ በግልጽ ከተመለከተው ተዋዋይ ውጪ ሌላ ሰው ተጠቃሚ እንዲሆን በማድረግ ፍርድ ቤቶች ውልን አንዲተረጉሙ ህግ ስለማይፈቅድ በእኔ ገንዘብ የተገዛ ቤት ነው በሚል በሌላ ሰው ስም የተገዛና የተመዘገበ ቤት ለማስለቀቅ የሚቀርብ ክስ ተቀባይነት የሌለው ስለመሆኑ
