በፍርድ ባለቀ ጉዳይ ላይ ዳግም ክስ ክልከላ ተፈፃሚነት በተከራካሪ ወገኖች በግልፅ ዳኝነት ተጠይቆበት ፍርድ ቤት በዝምታ ባለፈው ጉዳይ ላይ ጭምር ሲሆን ሆኖም በግልፅ ዳኝነት በተጠየቀበት ላይ ፍርድ ቤት በዝምታ የከለከለው መሆን ያለመሆኑ ከሌላኛው ተከራካሪ ወገን ከቀረበው ክርክር እና ጥያቄ ጋር ተገናዝቦ መታየት ያለበትና ተከሳሽ ወገን በግልፅ ክዶ ሊከራከርበት የሚገባ ስለመሆኑ
