መድን ሰጪ የሆነ ወገን በመድን ገቢው እግር በመተካት ባለዕዳ የሆነ ወገን ላይ ጥያቄ ባነሣ ጊዜ ባለዕዳው ከመድን ገቢው ጋር የሚፈጠር አለመግባባትን ከፍርድ ቤት ውጪ በሽምግልና ለመጨረስ የተስማማን በመሆኑ መድን ሰጪው በፍርድ ቤት ክስ መስርቶ ሊጠይቅ አይችልም በሚል የሚያቀርበው አቤቱታ የህግ መሠረት የሌለው ስለመሆኑ የንግድ ህግ ቁ. 683(1)
