አንድ የወንጀል ድርጊት ሊወድቅ የሚችልበት የህግ ድንጋጌ የተለያዩ የማክበጃ ነጥቦች በያዘ ጊዜ እና ተከሳሹ ጥፋተኛ በተባለበት አንቀጽ /ድንጋጌ/ ስር ያሉት ንዑስ ድንጋጌዎች የሚደነግጉት የቅጣት መጠን ተመሳሳይ በሆነ ጊዜ ፍርድ ቤቶች በዚያው የህግ ድንጋጌ ስር ድርጊቱ በይበልጥ ያሟላቸውን የማክበጃ ነጥቦች ወደ ያዘው ንዑስ ድንጋጌ መለወጥ የሚችሉ ስለመሆኑ፣
