በፍርድ ቤት የቀረበ ጉዳይ የክስ ምክንያት አለው ብሎ ለመወሰን የሚቻለው በክሱ ላይ የተገለፀው ነገር ቢረጋገጥ ከሳሹ የጠየቀውን ዳኝነት ለማግኘት ሕግ የሚፈቅድለት የሆነ እንደሆነ ስለመሆኑ፡- ማንኛውም ሰው በፍርድ ሊወሰን የሚገባውን ጉዳይ ለፍርድ ቤት ወይም ለሌላ በህግ የዳኝነት ስልጣን ለተሰጠው አካል የማቅረብ እና ውሳኔ ወይም ፍርድ የማግኘት መብት ያለው ስለመሆኑ፡- የኢፌድሪ ህገ መንግስት አንቀጽ 37(1)
