በጋብቻ ወቅት በአንደኛው ተጋቢ ምክንያት የተፈጠረ ዕዳ ለጋራ ጥቅም መዋሉ በተረጋገጠ ጊዜ የዕዳው ወደ የጋራ ንብረት ወይም ወደ ሌላኛው ተጋቢ የግል ንብረት በመሄድ ሊከፈል የሚችለው በፍርድ አፈፃፀም ላይ ስለመሆኑና ከዚህ ጋር በተያያዘ በሌላኛው ተጋቢ ላይ ዕዳውን መሠረት በማድረግ ክስ ሊመሰረትበትም ሆነ ፍርድ ሊሰጥበት የማይገባ ስለመሆኑ
