በቀድሞ ህግ እንደ ወንጀል የሚቆጠር ድርጊት በአዲሱ ህግ የወንጀል ድርጊት መሆኑ ቀሪ ከሆነ ጉዳዩ በወንጀል የሚታይበት አግባብ ስላለመኖሩ በአዲሱ የገቢዎችና ጉምሩክ አዋጅ መሰረት ከቀረጥ በነፃ በገባ እቃ አላግባብ መገልገል የወንጀል ተጠያቂነት ሳይሆን አስተዳደራዊ ተጠያቂነት ብቻ የሚያስከትል ስለመሆኑ
